Payments & Billing

- Any materials created by PMS remain our property until full payment is received
- Upon full payment, ownership of agreed deliverables may transfer to the client

Performance Disclaimer

- We do not guarantee specific results (e.g., revenue, rankings, or leads)
- Performance depends on multiple factors including market conditions, client cooperation, and external platforms
Limitation of Liability
To the fullest extent permitted by law:
- PMS is not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by the client for services in the preceding 30 days
Termination
Either party may terminate services with written notice, subject to the terms outlined in the service agreement.
Upon termination:
- Outstanding balances become immediately due
- Access to systems and services may be revoked
- Ongoing campaigns or automation may be paused or discontinued
Communication & Consent
By engaging with PMS, you consent to receive communications via:
- Phone calls
- SMS (if opted in)
These communications may include service updates, appointment reminders, and important account-related notifications.
SMS Terms of Service
Program Description: Pocono Marketing Solutions sends appointment confirmations, reminders, and updates to customers who have opted in.
Message Frequency: Message frequency varies based on user interaction and appointment volume.
Pricing: Message and data rates may apply.
Opt-Out: You can cancel the SMS service at any time. Just text 'STOP' to the short code. After you send the SMS message 'STOP' to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, simply sign up as you did the first time.
